Guardianship


Incapacitated Persons – A guardianship for an incapacitated adult is a court proceeding where an incapacitated person’s rights are taken away and delegated to a guardian. Guardianship is often expensive, costing thousands of dollars to establish and maintain, and should be pursued only after all other options have been exhausted. It is necessary when people can no longer manage their financial and/or health and personal affairs and they have not done the proper planning in advance (such as having a duly executed Durable Power of Attorney).
